How can you apply for a work permit as an immigrant?

If you are an immigrant in the U.S. and want to work legally, you need a work permit, also called an Employment Authorization Document (EAD). This document allows you to work for any employer while your immigration status is pending or if you qualify under a specific visa category.

Determine if you are eligible

Not all immigrants qualify for a work permit. You may be eligible if you have a pending green card application, Temporary Protected Status (TPS), asylum status, or a visa that permits employment. Certain spouses of visa holders and DACA recipients can also apply. Before filing, check if your immigration category allows work authorization.

Complete Form I-765

To apply, fill out Form I-765, Application for Employment Authorization. You can find this form on the U.S. Citizenship and Immigration Services (USCIS) website. Make sure to provide accurate personal information and select the correct eligibility category. Mistakes can delay processing or result in denial.

Gather supporting documents

Along with Form I-765, submit required documents, including proof of your current immigration status, a copy of your passport, and recent photos that meet USCIS guidelines. If renewing, include a copy of your previous EAD. Missing documents can slow down the process, so double-check all requirements before submitting.

Pay the filing fee or request a waiver

The USCIS filing fee for Form I-765 varies based on your category. Some applicants, like asylum seekers, may not have to pay. If you cannot afford the fee, you can request a fee waiver by submitting Form I-912 with proof of financial hardship.

Wait for USCIS approval

After submitting your application, USCIS will send a receipt notice. You may need to attend a biometrics appointment. Processing times vary, but you can check your case status online. If approved, you will receive your EAD, which allows you to work legally until it expires.

Keep your work permit valid

Your work permit is only valid for a set period. If you plan to continue working, apply for a renewal at least six months before it expires. Working without authorization can affect your immigration status, so stay informed about your permit’s expiration date.
