Future remains uncertain for many “Dreamers”

On Behalf of | Jul 30, 2020 | adjustment of status

The Deferred Action for Childhood Arrivals program, initially enacted in 2012, experienced legal challenges from the current U.S. presidential administration. This program allowed some people brought into the United States illegally when they were children to legally remain in the country and even attend school and work in the U.S.

People who participated in the DACA program were often referred to as Dreamers. Under DACA, legal status may be granted for a set period of time with the potential for a renewal of that status.

High court rules in favor of DACA

After the current federal administration challenged the legality of the Deferred Action for Childhood Arrivals program, the case made its way to the United States Supreme Court. As reported by CNN, the Supreme Court recently ruled that the program was legal and indicated its status should be reset to that of before the challenge.

Applicants unclear on status and options

Despite what many believe to be a very clear ruling by the Supreme Court, there remains much ambiguity and uncertainty around the future of the program. U.S. Citizenship and Immigration Services officially disagreed with the ruling. People who have submitted applications under DACA continue to wonder if their applications will be processed or reviewed at all. Some applications have been rejected for reasons that appear to raise more questions than they answer.

People in Kentucky who wish to seek approval for their status in the U.S. under DACA may find it helpful to consult with an experienced immigration attorney, especially as the program’s operation remains in a vague state.
