Types Of Visas Available

The Immigration and Nationality Act is filled with a variety of visa options designed to meet the needs of foreign nationals. Some visas are easier to obtain than others; the waiting period for some visas may be years. Our Louisville attorneys handle all types of immigrant and non-immigrant visas.   • J-1 and Q-1 Exchange Visitor Visa: Often used by students, teachers, researchers and others entering the U.S. through an exchange visitor program.
  • L-1 Intra-Company Transfer Visa: These allow managers, employees and executives to transfer to their company’s U.S.-based parent or affiliate.
  • U Visa: Available to certain crime victims who have suffered substantial physical or mental abuse.

Immigrant Visa Options

For most foreign nationals who are immediate relatives of U.S. citizens or permanent residents, the usual path for entry to the U.S. is through various family-based visa options. These include immigrant visas, as well as the K-1 and K-3 fiancé visas.

For foreign nationals without relatives in the U.S., employment-based visas become the best option. These are known as EB visas and include the following:

  • EB-1: A visa for foreign nationals of extraordinary ability, including professors, researchers and executives.
  • EB-2: A visa for those with advanced degrees or exceptional ability in the fields of art, science or business.
  • EB-3: A visa for skilled workers and professionals who have received job offers in the U.S.
  • EB-4: A visa available for certain religious workers.
  • EB-5: Visas available to foreign nationals who want to come to the U.S. to create jobs, and who have a plan to do so. At least 10 jobs must be created.
