Louisville Lawyers Handling Cancellation Of Removal

Cancellation of removal is a procedure that allows immigration judges and the Board of Immigration Appeals to end efforts to deport some people in Removal Proceedings under specific conditions. These conditions include:

  • The individual in question must have either lived in the U.S. for at least 10 years prior to the start of Immigration Court proceedings, or had the status of lawful permanent resident in the U.S. for at least five years (and have resided in the U.S. continuously for at least seven years after being admitted in any status).
  • The individual must be a person of demonstrably good moral character.
  • The individual may not have been convicted of any aggravated felony.
  • The individual is not inadmissible to the U.S. on security grounds.

Even if you are not a lawful permanent resident, you may apply if you have been in the country for 10 years and if you have a parent, child or sibling who is a citizen or permanent resident of the U.S.

If you need help in these matters, we are here for you. Call us in Louisville at 502-442-2039 or 888-832-2944. You can also complete our contact form. We represent individuals and families in Kentucky and worldwide.

How We Can Help

Located in Louisville, Kentucky, Vickerstaff Law Office, PSC, has helped many individuals avoid removal/deportation. The legal requirements are weighty, and the consequence of failure is deportation. For this reason, we invite you to call our lawyers today to see if you qualify for cancellation of removal.

A Note On Medical Disorders

Cancellation of removal is sometimes requested when the applicant’s family member has extreme medical hardships, and removal would undermine that person’s health. Judges are especially likely to grant cancellations to children with genetic disorders, people who are brain-damaged, severely handicapped persons, persons who have suffered extreme trauma or suffer from psychological disorders.

Upon review of the evidence, the immigration judge may cancel removal proceedings and grant the alien permanent residence.
